I agree that having it pivotted isn't the best, but even rigidly welded, a strut brace isn't going to prevent any up-down movement of the strut tops relative to each other. It has almost no strength in that direction.
Also every car is different, so a rigid brace either has to be made with loose bolt holes to ensure it fits, or you'll have to bend you body to get it on. My car has to be on perfectly level ground before I can fit my rigid brace, and it was welded up in that exact engine bay.
