The family of an elderly couple allegedly killed in a street race are upset the man charged over the deaths will never face court, after he was found dead in a car yesterday.

The 28-year-old man, from Glenmore Park, was due to face charges of street racing, dangerous driving and negligent driving over the July 29 deaths of Alan and Judith Howle, aged 71 and 70, at St Marys.

The man, who has not yet been formally identified, was out on bail for the alleged offences and was due to appear in Penrith Local Court on March 17.

Police were yesterday called to St Thomas Street in Mulgoa about midday where they discovered the man's body inside a car.

A Howle family member told The Daily Telegraph last night they were upset the man would not face his actions in court but also expressed grief for his family.

"We're just disappointed that he didn't get to face the consequences of his actions but on the other hand, our hearts go out to his family who now have to go through a loss of a loved one."

Crime scene officers and detectives were called to the scene but although the cause of his death is not known, police are not treating it as suspicious.

Police last night would not confirm a report that earlier yesterday the man had been informed the charges against him were to be upgraded to manslaughter.

But a police spokeswoman admitted officers were conducting further inquiries into those charges.

"Police were looking into these charges," the spokeswoman said.

"The NSW Coroner has directed that a critical incident investigation team be established to examine the circumstances surrounding the man's death.

"Police believe there are no suspicious circumstances involved."

It is alleged the man and two others were racing on the Great Western Highway on July 29 when they collided with the Howle's vehicle, killing them instantly.

Robert James Borkowski has been in jail since his arrest over the incident last year and is facing a number of charges including two counts of manslaughter.

The dead man and another 28-year-old from Hebersham were under investigation by the police crash investigation unit and were only charged last month.[/b]
