The problem with ISPs being asked to 'crack down' on this, is that usually the data that they see pass through typically won't actually show what the file will be when reformed at the user's end. Especially when it comes to torrents, where different parts of the file are coming form different sources on the web. If they don't have any evidence that ties the source/destination IP addresses to a particular file/s, then there is nothing they can do.
As for the searching.. thats a little extreme, but I'm sure there will be plenty standing in its way, especially if a legal precedent gets set against it.

Torrent traffic is easily detected.
The Comcast fiasco (in the US) , forced some users to enryption (I2P is my guess),
to prevent there downloads to be shapped ,
but yet they can "Predict" (assume its a torrent) the traffic and shape it anyway.
Torrents work , because they list your IP address as a tracker,
thus you can be caught.
Share (a japanese anonymous P2P network used on 2ch) , was thought to be amune ,
but last week 3 People where charged for uploading to the network.
Share was the answer to a Winny (no longer under development),
due weaknesses in its anonymity.
Freenet with the "Frost" layer (?? Usenet style) has been under a sustained DoS ,
for a quite while , and due to Freenets unbroken anonymity ,
there is no way to track down the attackers (my guess is the recording industry).
Tor (The Onion Router) Users can be traced,
with the right know how and motivation (mainly for Information Gathering).
Torrents , are more like slow trickle due to the slow transfer rates across the tor network.
As history goes ,
we will drop our old tools and start using others tools which will be harder to defeat,
so once again people will be able to pirate at there will.
In the long run Pirates (AHHhr) , will win ,
and the fat cats will lose more money fighting P2P ,
than they lose from actual sales.

Just because you use torrents don't think you are safe.
There have been instances where companies (ie. software / movie companies) aiming to bust people have set up a torrent for download, and everyone that downloaded they could see their IP and then reported to the ISP.
No one is safe on the net
ISP so far don't give two hoots what you download unless they have been told by an authority what you downloaded and they will issue a warning etc.
ISPs will unlikely want this to happen as they will loose customers, all their in it for is your money and don't care what goes one. Unless your a sick fuck who gets kiddy porn and the likes. They get rid of you then.
